Amendments to the General Law of Sustainable Forest Development and its consequences in the topic of Forest Land Use Change.

If you want to build, whether it is a small construction or a large tourist complex, and this involves a full or partial removal of forest vegetation, you would normally have to start a process called “application for forest land use change” which is submitted before the Ministry of Environment and Natural Resources (“SEMARNAT”) and you would have to make a payment for environmental compensation for reforestation or restoration activities which goes to the Mexican Forestry Fund which may sometimes be burdensome.
However, with the reforms on forest land use change that took place on June 5, 2018, when the New General Law of Sustainable Forest Development was published in the Federal Official Gazette, the jurisdiction of SEMARNAT was modified in certain cases, where it could be the case that you do not have to request the forest land use change before SERMARNAT, reducing costs and time for the project.
It shall be considered that environmental obligations are always delicate, so we recommend an analysis of the property being planned to be developed to verify if this exception is applicable and the procedure is carried out with due legal counsel.
